Maine has adopted Part 391 of the Federal Regulations with some exceptions.
Applicability
Part 391 applies to a vehicle with a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 pounds or more, or a vehicle transporting hazardous materials which require placarding.
Exception - Intrastate motor carriers operating less than 100 air miles from their regular place of business are subject to Secs. 391.13, 391.15, 391.23(a), 391.23(a)(1), 391.25(a), 391.25(b), 391.27(a), 391.27(b), and 391.41(b)(12)(i) but are otherwise exempt from all other sections of Part 391. Documents and records obtained from inquiries made pursuant to Secs. 391.23, 391.25, and 391.27 must be maintained on file by the motor carrier for a period of two years. Note: This exception does not apply to carriers hauling hazardous materials in a quantity requiring placarding.
Age
18 years to drive beyond a 100-air-mile radius intrastate, 21 years to haul hazardous materials in a quantity requiring placarding.
Driver qualification file
A driver qualification file (Sec. 391.51) is required. There is an exception to the physical qualification requirement. See Physical Qualification below for details.
Operator’s license
The license classes are as follows:
Class | Description |
---|---|
Class A | Any combination of vehicles with a gross vehicle weight rating of 26,001 or more pounds, provided the gross vehicle weight rating or gross weight of the vehicle or vehicles being towed is in excess of 10,000 pounds. |
Class B | Any single vehicle with a gross vehicle weight rating of 26,001 or more pounds or any such vehicle towing a vehicle not in excess of 10,000 pounds gross vehicle weight rating or gross weight. |
Class C | Any single vehicle or combination of vehicles that does not meet the definitions of Class A or Class B. Holders of a Class C license may, with an appropriate endorsement, operate all vehicles in that class. |
Physical qualification
Section 391.41(b)(11) (relating to hearing) was adopted only for intrastate drivers hauling hazardous materials requiring placarding.
