Kansas has adopted Part 391 of the Federal Regulations with the exception of Secs. 391.27(e), 391.47(b)(8), and 391.49(c)(2)(i).
Applicability
Part 391 applies to vehicles with a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 pounds or more, or vehicles transporting hazardous materials requiring placarding.
Exception — Private motor carriers domiciled in Kansas operating vehicles with a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 to 26,000 pounds are exempt from compliance with Part 391. This exemption does not apply to motor vehicles which are used in the transportation of hazardous materials and required to be placarded.
Age
Intrastate drivers must be 18 years old.
Driver qualification file
A driver qualification file (Sec. 391.51) is required. There is an exception to the physical qualification requirement. See Physical Qualification for details.
Operator’s license
The commercial driver’s license classes are as follows:
Class | Description |
---|---|
Commercial Class A | Any combination of vehicles with a gross combination weight rating (GCWR) of 26,001 pounds or more, provided the gross vehicle weight rating (GVWR) of the vehicle(s) being towed is more than 10,000 pounds. |
Commercial Class B | Any single vehicle with a GVWR of 26,001 pounds or more, or any such vehicle towing a vehicle with a GVWR of 10,000 pounds or less. |
Commercial Class C | Any single vehicle less than 26,001 pounds GVWR, or any such vehicle towing a vehicle with a GVWR of 10,000 pounds or less, or any such vehicle towing a vehicle with a GVWR of more than10,000 pounds, provided the combination weight rating is less than 26,001 pounds GVWR for vehicles: * Designed to carry 16 or more passengers, including the driver; or * Used to transport hazardous materials which require the vehicle to be placarded. |

Physical qualification
Any person failing to meet the physical qualification requirements of Sec. 391.41 may be permitted to drive a vehicle if the State Corporation Commission decides that the granting of a waiver is consistent with highway safety and the public interest.
