Applicability
Part 380 applies to drivers who possess a commercial driver’s license (CDL).
Part 391 applies to a self-propelled or towed vehicle bearing an apportioned plate or having a manufacturer’s gross vehicle weight rating or gross combination rating of at least 16,001 pounds. Part 391 also applies to a vehicle used on a public highway to transport a placardable amount of hazardous materials.
Age
Is at least 21 years old if engaged in interstate commerce or transporting hazardous materials of a type or quantity that would require the vehicle to be marked or placarded. All other drivers must be at least 18 years of age.
A driver qualification file (Sec. 391.51) is required. There is an exception to the physical qualification requirement. See Physical Qualification for details.
Entry-Level Driver training
Each employer must ensure each entry-level driver, who first begins operating a commercial motor vehicle requiring a commercial driver’s license under §42-2-404, CRS, receives the training required by Sec. 380.503.
Physical qualification
Drivers of intrastate vehicles and combinations of vehicles with a gross vehicle weight rating or gross combined weight rating of not more than 26,000 pounds, which do not require a commercial driver’s license to operate, are not subject to Part 391 Subpart E, Physical Qualifications and Examinations.
Any person not meeting the physical qualification requirements of Part 391, Subpart E, may apply with the Colorado State Patrol, Motor Carrier Safety Section for a variance/waiver. Carriers subject to the Public Utilities Commission must also contact that agency for driver qualification waiver possibilities.
Operator’s license
The driver’s license classes are as follows:
Class | Description |
Class A | Any combination of vehicles with a gross combination weight rating (GCWR) of 26,001 pounds or more, provided the gross vehicle weight rating (GVWR) of the vehicle(s) being towed is in excess of 10,000 pounds. Includes vehicles described under Class B and Class C. |
Class B | Any single unit vehicle with a GVWR of 26,001 pounds or more. May tow another vehicle provided its GVWR is 10,000 pounds or less. Includes vehicles described under Class C. |
Class C | Any single vehicle or combination of vehicles with a GVWR or GCWR of 26,000 pounds or less transporting quantities of hazardous material which require the vehicle to be placarded; or which is designed to transport 16 or more passengers, including the driver. |
Class R | Regular. Any vehicle with a gross vehicle weight or GCWR of 26,000 pounds or less, transporting no more than 15 passengers including the driver, and transporting no hazardous materials in quantities requiring placarding. |
