Federal regulations

West Virginia has adopted Part 393 of the Federal Regulations.

Applicability

Part 393 applies to any self-propelled or towed motor vehicle used on a highway in intrastate and interstate commerce when the vehicle has a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 pounds or more, or is of any size transporting a placardable amount of hazardous materials.

First aid kit

Required in intrastate wrecker trucks. No requirements for other vehicles.

Studded tires

No tire may have any block, stud, flange, cleat, spike or any other protuberance of any material other than rubber projecting beyond the tread surface of the tire.

Exception — Studded tires are allowed from November 1 until April 15, provided that no vehicle moved on a highway, other than school buses, shall be equipped with studded tires which are operational with a recommended air pressure greater than 40 pounds per square inch.

Tire chains

Tire chains of reasonable proportions are allowed when required for safety because of snow, ice, or other conditions tending to cause a vehicle to skid.
