Federal regulations
Delaware has adopted Part 393 of the Federal Regulations.
Applicability
Part 393 applies to a single vehicle or a vehicle in combination operated in intrastate commerce with a gross vehicle weight rating or gross vehicle weight over 26,000 pounds, and any size vehicle hauling hazardous materials requiring placards.
Back-up alarms
All commercial vehicles registered in Delaware, and titled on or after January 1, 2014, with a gross weight rating of 26,001 pounds or more must be equipped with:
- An audible reverse warning signal that alerts an individual within 50 feet of the vehicle that the vehicle intends to or is in the process of moving backwards in a reverse gear;
- A backup camera visible in the cab of the vehicle; or
- An audible warning device that will alert the driver when the vehicle is approaching the object.
Exception — This requirement does not apply to farm vehicles.
First aid kit
No requirement.
Mudflaps
Every bus or commercial motor vehicle operated on highways with a gross weight of 8,000 pounds or more, including semitrailers and trailers, must be equipped with suitable metal protectors or substantial flexible flaps behind the rearmost wheels of the vehicle or combination to prevent the projection of rocks, dirt, water or other substances to the rear and minimize side spray.
The flap, shield or other device shall extend down from the vehicle’s body to not more than 8 inches above the road surface, but not more than 15 inches when the vehicle is in an unloaded condition. The protector flap shall extend laterally at least the width of the tire being protected.
Exception — If the bus or commercial motor vehicle, including semitrailers and trailers, is designed or constructed so that the metal protector or flexible flap requirement listed above can be met due to fender or body construction or other means of enclosure, either permanent or temporary, the requirement has been met.
Studded tires
No tire may have blocks, studs, flanges, cleats, spikes, or other protuberances of any material other than rubber projecting beyond the tread surface.
Exception — The use of studded tires is permitted from October 15 to April 15.
Tire chains
Tire chains of reasonable size may be used on any vehicle when required for safety because of snow, ice, or other conditions causing a vehicle to slide or skid.
