The Commission rules that the Secretary of Labor lacked authority to expand the scope of the Walsh-Healey Public Contracts Act of 1936 (WHA) quick-drenching standard and apply the standard to the construction industry without notice-and-comment rulemaking. It concluded that OSHA’s quick-drenching provision, 29 CFR 1926.50(g), was invalidly promulgated as a construction standard, and, therefore, vacated the citation against Kiewit Power Constructors Co.
