Summary of differences between federal and state regulations
The federal minimum wage provisions are contained in the federal Fair Labor Standards Act (FLSA). Many states also have minimum wage laws. In cases where an employee is subject to both the state and federal minimum wage laws, the employee is entitled to the higher of the two minimum wages.
Effective January 1, 2023, the minimum wage for Rhode Island employees is $13 per hour.
Effective January 1, 2024, the minimum wage for Rhode Island employees is $14 per hour.
Effective January 1, 2025, the minimum wage for Rhode Island employees is $15 per hour.
Since January 1, 2017, allowance for gratuities as part of the hourly wage rate for restaurants, hotels, and other industries except taxicabs and limited public motor vehicles must be an amount equal to the applicable minimum rates less $3.89 per hour.
