Summary of differences between federal and state regulations
The federal minimum wage provisions are contained in the federal Fair Labor Standards Act (FLSA). Many states also have minimum wage laws. In cases where an employee is subject to both the state and federal minimum wage laws, the employee is entitled to the higher of the two minimum wages.
Effective January 1, 2025, the minimum wage for Montana employees is $10.55 per hour.
Effective January 1, 2024, the minimum wage for Montana employees is $10.30 per hour.
Effective January 1, 2023, the minimum wage for Montana employees is $9.95 per hour.
No tip credit, meal credit, or training wage is allowed under Montana law.
If, however, if your business has annual gross sales of $110,000 or less and individual employees are not dealing with interstate commerce or otherwise covered by the federal Fair Labor Standards Act, the minimum wage is $4.00 per hour.
The state minimum wage is adjusted each year according to the change in the federal Consumer Price Index (CPI) during the 12 months ending each August 31.
