Summary of differences between federal and state regulations
The federal minimum wage provisions are contained in the federal Fair Labor Standards Act (FLSA). Many states also have minimum wage laws. In cases where an employee is subject to both the state and federal minimum wage laws, the employee is entitled to the higher of the two minimum wages.
Effective January 1, 2023, the minimum wage for Maryland employees was $13.25 per hour ($3.63 for tipped employees).
The Fair Wage Act of 2023 (SB 555), enacted in April 2023, repealed Maryland’s annual state minimum wage increases that were based on employer size and changes to the Consumer Price Index scheduled for 2025 and 2026.
Instead, the Fair Wage Act mandates a uniform $15 hourly minimum wage for all employers, effective January 1, 2024.
