Summary of differences between federal and state regulations
Among the various employee benefit programs established and governed by ERISA are multiple employer welfare arrangements (MEWAs), which are subject as well to state regulatory and fiscal standards consistent with ERISA. Federal ERISA covers MEWAs. Some of the state provisions include the following:
- North Carolina law defines the term "multiple employer welfare arrangement" or "MEWA" as that term as defined in Section 3 of the Employee Retirement Income Security Act of 1974, 29 U.S.C. §1002, as amended.
- The MEWA must issue to each covered employee a policy, contract, certificate, summary plan description, or other evidence of the benefits and coverages provided.
- Each MEWA must maintain excess insurance.
