Summary of differences between federal and state regulations
Among the various employee benefit programs established and governed by ERISA are multiple employer welfare arrangements (MEWAs), which are subject as well to state regulatory and fiscal standards consistent with ERISA. Federal ERISA covers MEWAs. Minnesota has laws governing MEWAs.
The laws include the following provisions:
- Employers that choose to jointly self-insure must participate in the joint plan for at least three consecutive years. §62H.01
- A joint self-insurance plan must include aggregate excess stop-loss coverage and individual excess stop-loss coverage provided by an insurance company licensed by the state. §62H.02
- A joint self-insurance plan must pay assessments made by the Minnesota Comprehensive Health Association. §62H.04
- A joint self-insurance plan is exempt from providing the mandated health benefits in certain other Insurance Code sections if it otherwise provides the benefits required under ERISA. §62H.04
