Summary of differences between federal and state regulations

Among the various employee benefit programs established and governed by ERISA are multiple employer welfare arrangements (MEWAs), which are subject as well to state regulatory and fiscal standards consistent with ERISA.

Indiana has laws regarding MEWAs. A summary of the provisions are as follows:

• Arrangements must annually obtain a certificate of registration.
• Arrangements are allowed to provide benefits only through an employee benefit plan that has been filed and approved by the Department of Insurance.
• The Department of Insurance is to examine MEWAs every five years.
