The EPA has not had regulatory authority over medical waste since the Medical Waste Tracking Act of 1988 expired in 1991. Most states have since developed their own programs, resulting in significant differences for each state. A summary of this state’s requirements includes the following.
The State of Wyoming doesn’t have regulations specific to medical/infectious waste, apart from rules for incinerators and midwives.
The Wyoming Department of Environmental Quality regulates the air quality for medical/infectious waste incinerators (020 Wyo. Code 0002-4-5). The regulations cover:
- (a) Definitions;
- (b) Applicability;
- (c) Emissions limits;
- (d) Operator training and qualification requirements;
- (e) Waste management plan;
- (f) Inspection requirements;
- (g) Compliance, performance testing, and monitoring requirements;
- (h) Reporting and recordkeeping requirements; and
- (i) Compliance times.
The Wyoming Board of Midwifery regulates medical waste disposal for midwives (036 Wyo. Code 0001-7-8). The regulations cover:
- (a) Containers for non-sharp medical waste,
- (b) Containers for sharps, and
- (c) Storage duration.
