The EPA has not had regulatory authority over medical waste since the Medical Waste Tracking Act of 1988 expired in 1991. Most states have since developed their own programs, resulting in significant differences for each state. A summary of this state’s requirements includes the following.
The West Virginia Office of Environmental Health Services regulates infectious medical waste through the Infectious Medical Waste Program (64 CSR 56). The regulations cover:

- 56-4 Permit application and approval procedures for non-commercial infectious medical waste management facilities;
- 56-5 Infectious medical waste management plan;
- 56-6 Packaging and labeling;

- 56-9 Transportation;
- 56-10 Methods of treatment;
- 56-11 Commercial infectious medical waste management facilities;
- 56-12 Requirements related to manifests or shipping documents;
- 56-13 Recordkeeping and reporting;
- 56-14 Inspections, right of entry, sampling, and reports and analyses; and
- Table 64-56A Annual facility permit and operator registration fees.
