The EPA has not had regulatory authority over medical waste since the Medical Waste Tracking Act of 1988 expired in 1991. Most states have since developed their own programs, resulting in significant differences for each state. A summary of this state’s requirements includes the following.
The Oklahoma Department of Environmental Quality regulates medical waste (252 OAC 515). The regulations cover:
- 252:515-3-1 Solid waste permit requirements,
- 252:515-3-2 Solid waste permit exemptions,
- 252:515-3-40 Permits for commercial regulated medical waste processing facilities,
- 252:515-5-32 Restrictions on location of waste management and disposal areas,
- 252:515-19 Part 3 Operational requirements for all disposal facilities, and
- 252:515-23, which covers:
- Part 1 General provisions,
- Part 3 Operational requirements for all commercial regulated medical waste processing facilities, and
- Part 5 Additional operational requirements for commercial regulated medical waste incinerators.
