The EPA has not had regulatory authority over medical waste since the Medical Waste Tracking Act of 1988 expired in 1991. Most states have since developed their own programs, resulting in significant differences for each state. A summary of this state’s requirements includes the following.
The Department of Public Health regulates the storage, treatment, disposal, and transportation of medical and biological waste (105 CMR 480.00). The regulations cover:
- 480.020 Applicability;
- 480.100 Storage;
- 480.135 Sharps collection centers;
- 480.150 Approved disinfection methods;
- 480.200 Disposal;
- 480.300 Packaging, labeling, and shipping;
- 480.400 Shipping papers;
- 480.425 Tracking medical or biological waste for treatment;
- 480.500 Procedures, records, and recordkeeping log; and
- 480.550 Approval of alternative methods of treatment, storage, and disposal.
The Department of Environmental Health also regulates certain aspects of medical and biological waste (310 CMR 19). The regulations cover:
- 19.061(2) Exclusions to the management requirements, and
- 19.061(3) Management requirements for medical or biological waste (including general and specific requirements).
