The EPA has not had regulatory authority over medical waste since the Medical Waste Tracking Act of 1988 expired in 1991. Most states have since developed their own programs, resulting in significant differences for each state. A summary of this state’s requirements includes the following.
The Maryland Department of Health regulates special medical waste and the criteria by which treatment methods are evaluated to determine whether the treatment creates a regulated or nonregulated waste product (10 COMAR 10.06.06). The regulations cover:
- 06.01 Applicability;
- 06.03 Handling of special medical waste;
- 06.04 Treatment of special medical waste, excluding sharps, before disposal;
- 06.05Treatment of sharps before disposal;
- 06.06 Alternative treatment systems; and
- 06.07 Disposal of special medical waste.
The Maryland Department of the Environment provides permitting and regulates all aspects of special medical waste transportation in addition to requiring medical waste handlers to notify the department of medical waste activity (26 COMAR 11, 13, and 15). The regulations cover:
- 26.11.02.13 Sources subject to state permits to operate;
- 26.11.08.03 Prohibition of certain incinerators in Areas III and IV;
- 26.11.08.05(B)(2)(a) Particulate matter emission requirements for Areas III and IV;
- 26.11.08.08-02 Monitoring requirements for hospital, medical, and infectious waste incinerators;
- 26.11.08.09 Incinerator operator training;
- 26.13.11.01–.03 Applicability and exclusions of special medical waste disposal regulations;
- 26.13.12 Standards applicable to generators of special medical waste;
- 26.13.13 Standards applicable to transporters of special medical waste; and
- 26.15.02.04 Minimum predisposal requirements for classes of radioactive hazardous substances.
