The EPA has not had regulatory authority over medical waste since the Medical Waste Tracking Act of 1988 expired in 1991. Most states have since developed their own programs, resulting in significant differences for each state. A summary of this state’s requirements includes the following.
The State of Kentucky has no specific regulations pertaining to medical waste and no one state agency with jurisdiction over medical waste. However, there are regulations that reference the characterization, treatment, handling, labeling, storage, transport, and disposal of this type of waste. These regulations are enforced by various state agencies. The regulations cover:
- 401 KAR 047:080 Classification of solid waste sites or facilities,
- 401 KAR 047:110 Registered permit-by-rule,
- 401 KAR 049:080 Solid waste grant funds and solid waste collector and recycler registration,
- 401 KAR 059:020 New incinerators,
- 401 KAR 061:010 Existing incinerators,
- 902 KAR 020:016 Hospitals: operations and services,
- 902 KAR 020:101 Facility specifications: ambulatory surgical center,
- 902 KAR 020:260 Hospital-owned pain management clinics,
- 902 KAR 020:275 Freestanding or mobile technology,
- 902 KAR 020:300 Operation and services: nursing facilities,
- 902 KAR 020:410 Specialty intermediate care clinics, and
- 902 KAR 045:065 Tattooing.
