The EPA has not had regulatory authority over medical waste since the Medical Waste Tracking Act of 1988 expired in 1991. Most states have since developed their own programs, resulting in significant differences for each state. A summary of this state’s requirements includes the following.
Hawaii’s Department of Health regulates medical and infectious waste. The regulations cover:
- 11 HAR 58.1-52 Medical waste treatment and disposal facilities, and
- 11 HAR 104.1 Management and disposal of infectious waste, including:
- Subchapter 1 General provisions,
- Subchapter 2 Handling, transporting, and storing untreated infectious waste within a generating facility,
- Subchapter 3 Treating and storing treated infectious waste within a generator facility,
- Subchapter 4 Standards for infectious waste generators and transporters, and
- Subchapter 5 Enforcement (including penalties).
