Title 76 Torts, §76-5: Responsibility for negligence; “Good Samaritan Act.” Paragraph (a)(2) provides immunity for rescuers.
§76-5A: Medical care or treatment by use of automated external defibrillator – Immunity from civil liability. Provides immunity for persons who use AEDs in good faith and without expectation of compensation, renders emergency care or treatment outside of a medical facility using an AED, except for acts of gross negligence or willful or wanton misconduct in the use of the AED.
Owners, lessees, or possessors of AEDs are provided immunity for actions of those who use the devices, except for acts of gross negligence or willful or wanton misconduct in the use of the AED. This section also provides a definition of an AED.
