May a 150-air-mile-radius driver use the 16-hour exception in 395.1(o)?
Yes and no. A driver operating under the 150-air-mile exception in 395.1(e)(1) may also meet the requirements of the 16-hour exception in 395.1(o), enabling the driver to have one period of 16 hours on duty each week (or after a 34-hour restart). However, when a driver uses the 16-hour exception, he or she works past the 14th hour of the day, which is not allowed under the 150-air-mile exception. Therefore, both exceptions cannot be used on the same day. When the 16-hour exception is used, the driver must maintain a standard log for that day and must comply with the 30-minute break requirement. Note that drivers using the 150-air-mile exception for drivers of non-CDL property-carrying vehicles in 395.1(e)(2) cannot also use the exception in 395.1(o) to obtain three 16-hour days per week.
