Summary of differences between federal and state regulations
Medical marijuana
A qualifying patient acting in accordance with the law may not be subject to arrest, prosecution, or civil or administrative penalty for the medical use of marijuana. The law does not address employment issues.
Recreational marijuana
Maryland’s Cannabis Reform Act does not address marijuana use, testing, or impairment in the workplace. Employers may test for cannabis and take action against employees who test positive.
