The List of Lists is a publication issued by EPA, which offers a consolidated chemical list of chemicals subject to reporting requirements under several environmental laws. The publication was prepared to help facilities handling chemicals determine whether they need to submit reports under the laws covered by the list, and for a specific chemical, what reports may need to be submitted. Caution should be used, however. The List of Lists is not a regulation and should be used only as a reference tool, not as a definitive source of compliance information.
The chemicals on the consolidated list are ordered both by the Chemical Abstracts Service (CAS) registry number and alphabetically. More than one chemical name may be listed for one CAS number because the same chemical may appear on different lists under different names. The chemical names on the consolidated lists generally are those names used in the regulatory programs developed under:
Emergency Planning and Community Right-to-know Act (EPCRA) sections 302, 304, and 313;
Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) sections 102 and 103;
Clean Air Act (CAA) section 112(r)(7); and
Clean Water Act (CWA) section 311(j)(5).
Yet, each chemical may have other synonyms that do not appear on these lists.
Scope
The chemicals covered by the consolidated List of Lists include:
Extremely hazardous substances and their threshold planning quantities and reportable quantities listed under sections 302 and 304 of the EPCRA and regulation 40 CFR 355;
Toxic chemicals listed under section 313 of EPCRA and regulation 40 CFR 372;
Hazardous substances and their reportable quantities under CERCLA and regulation 40 CFR 302.4;
Regulated substances and their threshold quantities under section 112(r)(7) of the CAA and regulation 40 CFR 68.130; and
Hazardous substances at 40 CFR 116.4 and their 40 CFR 118.3 threshold quantities calculated as 1,000 times the reportable quantities listed in 40 CFR 117.3, as authorized by CWA section 311(j)(5).
Where an above chemical is also a P or U chemical under the Resource Conservation and Recovery Act (RCRA), the List of Lists offers an indicator, but not all RCRA P and U chemicals are provided the List of Lists.
The List of Lists publication also includes appendices with:
Reportable radionuclides listed under CERCLA and 40 CFR 302;
Waste stream codes, names, and reportable quantities for F and K listed and unlisted characteristic hazardous wastes under the RCRA and 40 CFR 261;
Chemical categories under Section 313 of EPCRA and 40 CFR 372.65;
Categories of hazardous substances listed under CERCLA and 40 CFR 302.4.
The List of Lists does not include all hazardous chemicals subject to the reporting requirements in EPCRA Sections 311 and 312 and regulation 40 CFR 370.
Note: The List of Lists only updates irregularly. It does not update when the related regulations change. Therefore, the List of Lists may lag behind the regulations and be out-of-date. Moreover, the List of Lists is not an official regulation and should not be used as a definitive source for compliance.
Regulatory citations
40 CFR 68 — Chemical accident prevention provisions
Regulated substance: Any substance listed pursuant to section 112(r)(3) of the Clean Air Act as amended, in 68.130.
Release: Any spilling, leaking, pumping, pouring, emitting, emptying, discharging, injecting, escaping, leaching, dumping, or disposing into the environment (including the abandonment or discarding of barrels, containers, and other closed receptacles) of any hazardous chemical, EHS, CERCLA hazardous substance, or toxic chemical.
Reportable quantity: For any CERCLA hazardous substance, the quantity established in Table 302.4 of 40 CFR 302.4, for such substance. For any EHS, reportable quantity means the quantity established in Appendices A and B of 40 CFR 355 for such substance. Unless and until superseded by regulations establishing a reportable quantity for newly listed EHSs or CERCLA hazardous substances, a weight of 1 pound shall be the reportable quantity.
Toxic chemical: A chemical or chemical category listed in 372.65.
Threshold planning quantity: For a substance listed in Appendices A and B of 40 CFR 355, the quantity listed in the column “threshold planning quantity” for that substance.
Threshold quantity: For the CAA, the quantity specified for regulated substances pursuant to section 112(r)(5) of the Act as amended, listed in 68.130 and determined to be present at a stationary source as specified in 68.115. For the CWA, the maximum quantity onsite for any CWA hazardous substance listed at 116.4 at any time, meets or exceeds 1,000 times the reportable quantity in pounds (kilograms) found at 117.3.
