Summary of difference between federal and state regulations
The Fair Labor Standards Act does not require payment for time not worked. This type of benefit is generally a matter of agreement between an employer and an employee (or the employee’s representative). Employers, however, do need to comply with applicable state laws.
Jury duty
Pennsylvania law doesn’t require private employers to pay employees for jury duty.
Voting
Pennsylvania doesn’t have a time-off-for-voting provision.
Attend court
Pennsylvania law provides that employers must not deprive an employee of his or her employment, seniority position, or benefits, or threaten or otherwise coerce him or her, because the employee attends court as a victim of, or a witness to, a crime. Employers are not required to compensate the employee for employment time lost because of such court attendance.
Violation of the law may bring a civil action for recovery of wages and benefits lost as a result of the violation and for an order requiring the reinstatement of the employee.
