Utah has adopted Part 396 of the Federal Regulations.
Applicability
Part 396 applies to an intrastate commercial vehicle:
- With a gross vehicle weight rating (GVWR), gross vehicle weight (GVW), gross combination weight rating (GCWR), or gross combination weight (GCW) of 26,001 or more pounds and is operated by an individual who is 18 years old or older;
- With a GVWR or GCWR of 16,001 or more pounds if the vehicle is operated by an individual under 18-years old; or
- Used to transport placardable hazardous materials.
Mandatory inspection program
The mandatory vehicle inspection program in Utah is administered by the Department of Public Safety, Utah Highway Patrol, Vehicle Safety Section. All vehicles required to be registered in Utah are subject to the vehicle inspection program.
A vehicle with a gross vehicle weight rating (GVWR) of 10,001 pounds or more is required to pass the inspection annually.
The inspections must be conducted by a certified safety inspector at an authorized safety inspection station. Vehicles that pass the inspection are issued a safety inspection certificate.
This mandatory inspection program is considered equivalent to the Federal annual inspection requirement in Part 396.
Exception — Utah’s mandatory inspection requirement does not apply to a commercial motor vehicle that has a GVWR over 26,000 pounds and any attached trailer, semitrailer, or trailing equipment that is operating with an apportioned registration and has a valid annual inspection that complies with Sec. 396.17.
