Tennessee has adopted Part 396 of the Federal Regulations.
Applicability
Part 396 applies to commercial motor vehicles operated in intrastate commerce to transport property that have a gross vehicle weight rating or gross combination weight rating of 26,001 pounds or more, or a motor vehicle of any gross vehicle weight transporting hazardous materials. However, a Tennessee Highway Patrol officer having probable cause to believe such a commercial motor vehicle is being operated with unsafe loading or mechanical conditions may inspect the vehicle. If the officer determines the vehicle is being operated with unsafe loading or mechanical conditions, the officer must place the vehicle out of service.
