New Jersey has adopted Part 396 of the Federal Regulations.
Applicability
Part 396 applies to an intrastate vehicle with a gross vehicle weight, gross vehicle weight rating, gross combination weight, gross combination weight rating, or registered weight of 10,001 pounds or more, or a vehicle of any size transporting a placardable amount of hazardous materials.
Mandatory inspection program
An official mandatory periodic vehicle inspection program is administered by the Motor Vehicle Commission. All gasoline-fueled and bi-fueled motor vehicles that are registered as commercial motor vehicles are subject to annual inspection. This inspection must be performed at a state-licensed private inspection facility.
Diesel-fueled motor vehicles having a gross vehicle weight rating of 8,501 to 17,999 pounds that are plated commercial fall under the state’s self-inspection program. These vehicles must be inspected annually by the vehicle’s owner or lessee.
Heavy-duty diesel-powered motor vehicles having a gross vehicle weight rating of 18,001 pounds or more are subject to an annual inspection performed at a state-licensed private inspection facility.
This mandatory inspection program is considered equivalent to the Federal annual inspection requirement in Part 396.
