The “split sleeper” provision allows drivers to split their 10-hour rest break into two “qualifying” breaks. These two qualifying breaks must consist of a minimum 7-consecutive-hour sleeper-berth period plus another period of at least 2 consecutive hours comprised of off-duty or sleeper-berth time for a total of at least 10 hours. Each of these two qualifying breaks can be excluded from calculation of the 14-hour limit under 395.3, for drivers of property-carrying commercial motor vehicles. All other time is included in the 14-hour calculation.
