Ohio has adopted Part 395 of the Federal Regulations.
Applicability
Part 395 applies to vehicles operated by for-hire carriers with a gross vehicle weight rating or gross combination weight rating, or gross vehicle weight or gross combination weight of 10,001 pounds or more (whichever is greater).
Part 395 applies to vehicles operated by private carriers with a gross combination weight rating or gross combination weight of 26,001 pounds or more, whichever is greater, inclusive of a towed unit(s) with a gross vehicle weight rating or gross vehicle weight of more than 10,000 pounds, or a single vehicle operated by a private carrier with a gross vehicle weight rating or gross vehicle weight of 26,001 pounds or more.
Part 395 also applies to any size vehicle (for-hire or private) transporting a placardable amount of hazardous materials.
Exception — A driver driving for a motor carrier engaged in the intrastate transportation of construction materials and equipment will be allowed to drive for 12 hours following 10 consecutive hours off duty. A driver may not drive after being on duty for 16 hours following 10 consecutive hours off duty. If the motor carrier does not operate commercial motor vehicles every day of the week, a driver will not be permitted to drive after being on duty 70 hours in 7 consecutive days. If the motor carrier operates commercial motor vehicles every day of the week, a driver will not be permitted to drive after being on duty 80 hours in 8 consecutive days.
An intrastate driver who is primarily used in the transportation of construction materials and equipment may end any 7- or 8-consecutive day period with the beginning of any off-duty period of 24 or more successive hours.
Transportation of construction materials and equipment is defined as the transportation of construction and pavement materials, construction equipment, and construction maintenance vehicles, by a driver to or from an active construction site (a construction site between mobilization of equipment and materials to the site to the final completion of the construction project) within a 50 air mile radius of the driver’s normal work reporting location.
Note: This exception does not apply if a carrier is hauling a placardable amount of hazardous materials.
Exception — Under Ohio’s adoption of §395.1(k), the state’s planting and harvesting season is January 1 through December 31 of each year.
Electronic logging device (ELD)
Ohio has adopted the electronic logging device (ELD) requirements in Part 395 for intrastate motor carriers and drivers.
