North Dakota has adopted Part 395 of the Federal Motor Carrier Safety Regulations (FMCSRs), and amendments as they occur.
Part 395 applies to intrastate commercial motor vehicles with a gross vehicle weight, gross vehicle weight rating, gross combination weight, and gross combination weight rating of 26,001 pounds or more, or a vehicle used to transport hazardous materials requiring a placard.
Hours-of-service limitations do not apply to an intrastate driver transporting agricultural commodities or farm supplies, including farm equipment or machinery, for agricultural purposes during planting and harvesting seasons, if the transportation is limited to an area within a 150 air-mile radius from the source of the commodities or the distribution point for the farm supplies.
North Dakota’s planting and harvesting season is January 1 through December 31.
