Colorado has adopted Part 395 of the Federal Motor Carrier Safety Regulations (FMCSRs), as in effect on October 1, 2024.
Part 395 applies to a self-propelled or towed vehicle bearing an apportioned plate or having a manufacturer’s gross vehicle weight rating or gross combination rating of at least 16,001 pounds. Part 395 also applies to a vehicle used on a public highway to transport a placardable amount of hazardous materials.
Under Colorado’s adoption of 395.1(k), the state’s planting and harvesting season is January 1 through December 31 of each year. Note: Drivers transporting livestock, poultry, slaughtered animals or the grain, corn feed, hay etc. used to feed the animals are also eligible to use this exception.
Exception: Section 395.3 or Section 395.5 do not apply to Colorado governmental or tow truck drivers working an emergency, as defined in Part 390.
Exception: Section 395.3 does not apply to tow drivers who are towing a vehicle from a public roadway at the request of a police officer for other law enforcement purposes.
Electronic logging device (ELD)
Colorado has adopted the electronic logging device (ELD) requirements in Part 395 for intrastate motor carriers and drivers.
