Maryland generally adopts the federal hazardous waste regulations under RCRA (40 CFR Parts 260–273) but includes several state-specific rules and enforcement practices that make it stricter and more proactive in some areas. Maryland’s program is overseen by the Maryland Department of the Environment (MDE), specifically the Hazardous Waste Program under the Land and Materials Administration.
Below is a summary of those differences:
- Hazardous Waste Determination – Follows federal, but the state reserves the right to classify additional wastes as hazardous under Environment Article 7–201–7–266, Annotated Code of Maryland.
- Reporting – All generators of Hazardous Waste must submit annual and biennial reports.
- Labeling – Additional labeling requirements include Listing each hazardous waste characteristic of those identified, providing hazard communication information, providing a hazard statement or pictogram consistent with the U.S. Occupational Health and Safety Administration Hazard Communication Standard, providing a chemical hazard label consistent with the National Fire Protection Association Code 704, or some other method that is at least as effective as any of the methods listed.
- VSQG – Maryland refers to generators that do not meet the criteria of a LQG or SQG as a "Maryland-defined small quantity generator".
