The Clearinghouse is an online database that gives employers, the FMCSA, state driver licensing agencies, and law enforcement personnel real-time information about CDL driver drug and alcohol program violations.
Motor carriers are required to check the Clearinghouse annually for each CDL driver who is subject to FMCSA-mandated drug and alcohol testing. Before running an annual query, the motor carrier must have the driver’s consent. This form is used to get a driver’s consent to run “limited” annual queries in the Clearinghouse for the duration of the driver’s employment (although drivers have the right to limit the term of consent to a shorter period of time). If a “limited” annual query ever reveals that the Clearinghouse has information about a driver, the motor carrier must run a “full” query within 24 hours.
