Idaho has no state family and medical leave provisions for private employers; therefore, the federal FMLA provisions would apply. The state does have parental leave for state executive branch employees.
Effective July 1, 2020, under the Families First Act, all state executive branch entities must offer eight weeks of paid parental leave as a separate benefit to eligible employees after the birth or adoption of a child. This means that these employees will not use their accrued sick or vacation hours for the leave. The Executive Order providing for this leave does not, however, define what makes an employee eligible.
