Summary of differences between federal and state regulations
Employers are not required by federal law to give former employees their final paycheck immediately. Some states, however, may require immediate payment or payment within a specific time period.
Montana Code §39-3-205 requires that for voluntary termination the final paycheck must be paid on the next scheduled payday or 15 days from the date of termination. For involuntary termination the final paycheck is due immediately, unless the employer has a written personnel policy governing the employment that extends the time for payment of final wages to the employee’s next regular payday for the pay period or to within 15 days from the separation, whichever occurs first.
