Summary of differences between federal and state regulations
Employers are not required by federal law to give former employees their final paycheck immediately. Some states, however, may require immediate payment or payment within a specific time period.
In Georgia, paychecks are due twice a month on the regular payday. However, the state does not have any laws regarding final paychecks. The final paycheck does not have to be provided until the next regular payday, regardless of whether the separation was voluntary or involuntary.
The state’s website of FAQs (https://dol.georgia.gov/faqs-employers) does not address final pay, and the state does not appear to take enforcement action against employers who fail to provide final wages. Employees who do not receive the final wages by the next regular payday are simply advised to contact the federal Wage & Hour Division.
