In accordance with Title 38, United States Code, Section 4212(d), the U.S. Department of Labor (DOL), Veterans' Employment and Training Service (VETS) collects and compiles data on the employment of veterans with Federal contractors and subcontractors.
The Vietnam Era Veterans' Readjustment Assistance Act of 1974 (VEVRAA) and its implementing regulations at 41 CFR part 61-250 require contractors and subcontractors with Federal contracts to submit the VETS-4212 Report that identifies four specified categories: veterans of the Vietnam era; special disabled veterans; other protected veterans; and recently separated veterans.
The VETS-4212 Report should be filed if a business has a current federal government contract or subcontract worth $150,000 or more, regardless of the number of employees. The contract or subcontract may be with any department or agency of the United States for the procurement of personal property or non-personal services. Services include, but are not limited to, utility, construction, transportation, research, insurance, and fund depository, regardless of whether the government is the purchaser or seller.
The obligation to report is the responsibility of the contractor or subcontractor. If unsure of the requirements to file a report, please contact the authority requesting that the report be filed for clarification. Generally speaking, this authority is the federal contracting officer (CO) in charge of awarding the contract.
