Summary of differences between federal and state regulations
Employer defined
“Employer” means any person within South Dakota who hires or employs any employee, and any person wherever situated who hires or employs any employee whose services are to be partially or wholly performed in the South Dakota.
Unlawful employment practices
The state law does not include specific provisions similar to those in the federal Equal Pay Act. However, discrimination based on sex includes wage discrimination (or other forms of compensation). Also, the state law notes exemptions based on seniority, job description, merit or executive training systems. The protections are therefore similar to the Equal Pay Act.
