Summary of differences between federal and state regulations
Indiana does not regulate wage discrimination at the state level. It is handled at the federal level through the Equal Employment Opportunity Commission (EEOC). However, the state does have recordkeeping requirements that may apply in wage discrimination disputes, as well as laws prohibiting gender discrimination.
Every employer must keep a true and accurate record of the name, address or occupation of each person employed by him, and of the daily and weekly hours worked and of the wages paid each pay period. The record of the daily and weekly hours worked or of the wages paid is not required for any person employed in a bona fide executive, agricultural, domestic, administrative or professional capacity or in the capacity of an outside salesman.
