Summary of differences between federal and state regulations
Employer defined
“Employer” means any person employing ten or more employees and acting directly or indirectly in the interest of an employer in relation to an employee. The term ‘employer’ means an employer who is engaged in intrastate commerce.
Unlawful employment practices
The unlawful employment practices and exemptions are similar to those under the federal Equal Pay Act. For example, the state law includes exemptions for seniority, merit systems, quantity or quality of production, or other factors not based on sex.
Court action in the state may be commenced no later than one year after the cause of action accrues.
Posting
Every covered employer must keep an abstract or copy of the regulation (Title 34, Chapter 34-5) posted in a conspicuous place in or about the premises wherein any employee is employed.
