Summary of differences between federal and state regulations
Definitions
“Employer” means any owner or any person, partnership, corporation, limited liability company or association of persons acting directly as, or in behalf of, or in the interest of an employer in relation to employees, including the state and any political subdivision.
Unlawful employment practices
The unlawful employment practices and exemptions are similar to those under the federal Equal Pay Act. No employer may discriminate in the compensation paid to any employee on the basis of sex. Any difference in pay based on sex will be deemed discrimination.
If an employee can demonstrate that the employer discriminates on the basis of sex by paying wages at a lesser rate compared to employees of the opposite sex in equivalent jobs, the employer must demonstrate that the differential is made pursuant to (1) a seniority system; (2) a merit system; (3) a system which measures earnings by quantity or quality of production; or (4) a differential system based upon a bona fide factor other than sex, such as education, training or experience. This defense may be used only if the employer demonstrates that such factor (a) is not based upon or derived from a sex-based differential in compensation, and (b) is job-related and consistent with business necessity.
Discrimination in compensation occurs when a discriminatory compensation decision or practice is adopted, when an individual is subject to a discriminatory compensation decision or practice, or when an individual is affected by application of a discriminatory compensation decision or practice, and shall be deemed to be a continuing violation each time wages, benefits or other compensation is paid.
