Summary of differences between federal and state regulations
Polygraph protection
Polygraph protection provisions apply to employees and prospective employees in the private-sector and in state and local governments. Employers may not require as a condition of employment or continued employment that an applicant or employee take a polygraph examination. These rules have exceptions for law enforcement agencies screening candidates for employment. Each employment application must show, in bold-faced upper case type, the following notice: "Under Maryland law, an employer may not require or demand, as a condition of employment, prospective employment, or continued employment, that an individual submit to or take a lie detector or similar test. An employer who violates this law is guilty of a misdemeanor and subject to a fine not exceeding $100."
Polygraph examiners
Maryland does not have state-level polygraph examiner requirements. Examiners must meet the federal requirements at 29 CFR 801.26.
