Summary of differences between federal and state regulations
Polygraph protection
Polygraph protection provisions apply to employees and prospective employees in the private-sector and in state and local governments. Employers may not require as a condition for employment or continuation of employment any person or employee to take a polygraph test or any form of a “lie detector test.” These rules do not apply to any law enforcement agency of the United States, the state of Idaho, or any political subdivision.
Polygraph examiners
Idaho does not have state-level polygraph examiner requirements. Examiners must meet the federal requirements at 29 CFR 801.26.
