Summary of differences between federal and state regulations
Polygraph protection
Polygraph protection provisions apply to employees and prospective employees in the private-sector. Employees and applicants may not be required to or demanded to submit to a polygraph or similar test as a condition of obtaining or continuing employment. If an employer requests a polygraph test, he or she must first provide employees or applicants with written notification of their rights.
California public safety officers may not be compelled to take a polygraph test.
Polygraph examiners
California does not have state-level polygraph examiner requirements. Examiners must meet the federal requirements at 29 CFR 801.26.
