Summary of differences between federal and state regulations
Federal contractors who receive qualifying contracts must participate in the E-Verify Program, using it to verify new employees and existing employees assigned to a federal contract (qualifying federal contractors may choose to verify the entire workforce). Employers without federal contracts are not required by federal law to use E-Verify, but they may be required to do so by state law.
Nebraska law requires certain employers to use E-Verify. The law affects public employers, public contractors, and private employers that apply for the following state tax incentive programs:
- Nebraska Advantage Act,
- Nebraska Advantage Rural Development Act,
- Nebraska Advantage Microenterprise Tax Credit Act, and
- Nebraska Advantage Research and Development Act.
Nebraska participates in E-Verify’s Records and Information from DMVs for E-Verify (RIDE) program. RIDE enables E-Verify to confirm information from drivers’ licenses and state identification cards presented by employees as List B (identity) documents by matching the data against jurisdiction records.
