Federal regulations
Oregon has adopted Part 392 of the Federal Regulations.
Applicability
Part 392 applies to intrastate and interstate operations when the vehicle has a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 pounds or more, or is of any size transporting a placardable amount of hazardous materials.
Engine idling
A commercial vehicle with a gross vehicle weight rating (GVWR) greater than 10,000 pounds may not idle for more than 5 minutes in any continuous 60-minute period.
Exceptions — A commercial bus may idle to maintain the comfort of passengers while passengers are on board.
A commercial vehicle may idle for a maximum of 30 minutes while waiting to load or unload or when actually loading or unloading during a single loading or unloading event.
A commercial vehicle with a GVWR of more than 26,000 pounds, that is equipped with a sleeper berth, and is parked in a place where it is legally permitted to park, may idle for the purposes of air conditioning or heating during a rest or sleep period when the outside temperature is less than 50°F or greater than 75°F at any time during the rest or sleep period.
A commercial vehicle with a GVWR of more than 26,000 pounds, may idle for the purposes of air conditioning or heating while waiting to load or unload the vehicle or when actually loading or unloading the vehicle when the outside temperature is less than 50°F or greater than 75°F.
There are also exceptions for:
- traffic conditions;
- operation of defrosters, heaters, or air conditioners;
- installing equipment necessary to comply with manufacturers’ requirements, specifications, warranties;
- compliance with federal, state, or local safety regulations;
- emergency vehicles;
- vehicle maintenance or repair;
- vehicle inspection;
- powering work-related mechanical, safety, electrical, or construction equipment; and
- armored vehicles when a person must remain inside to guard the contents or while the vehicle is being loaded or unloaded.
Speed limit
The speed limit for trucks is 65 mph or as posted.
