Federal regulations
Delaware has adopted Part 392 of the Federal Regulations.
Applicability
Part 392 applies to a single vehicle or a vehicle in combination operated in intrastate commerce with a gross vehicle weight rating or gross vehicle weight over 26,000 pounds, and any size vehicle hauling hazardous materials requiring placards.
Engine idling
A self-propelled vehicle designed to transport property or passengers with a gross vehicle weight rating of greater than 8,500 pounds may not idle for more than three consecutive minutes when the vehicle is not in motion.
Exceptions — A vehicle may idle for up to 15 consecutive minutes to provide heat to the occupant when the temperature is between -10°F and 32°F. There is no limit when the temperature is below -10°F and no nuisance is created.
A transit or school bus may idle for up to five minutes prior to passenger boarding.
There are also exceptions for:
- traffic conditions or mechanical difficulties over which the vehicle operator has no control;
- bringing the vehicle to the manufacturer’s recommended operating temperature;
- repair;
- emergency vehicles;
- use of auxiliary power for equipment to perform the intended operation of the vehicle (power take off generator for utility truck);
- operation of heater, air conditioner, or any ancillary equipment when sleeping or resting in a sleeper berth when the vehicle is not within 25 miles of a parking facility with electrification equipment;
- daily vehicle inspection;
- transit or school bus vehicles when passengers on board; and
- military tactical vehicles engaged in training.
Speed limit
The speed limit is 65 mph on specified highways, 55 mph (or as posted) on other highways.
