Drivers operating public service vehicles or regulated vehicles that are not public service vehicles must, without delay, disclose the following to the vehicle operator (motor carrier):
- Details surrounding traffic accidents that are reported under the Highway Traffic Act;
- Convictions resulting from the operation/care of a motor vehicle under the Highway Traffic Act, The Drivers and Vehicles Act, the Criminal Code, the Transportation of Dangerous Goods Act (Canada), the regulations associated with these acts, any other acts or regulations similar to those described here but under state, district, or territory of the United States, or any by-law made by a traffic authority and established by regulation; and
- A suspension, cancellation, prohibition, or change in the driver’s license or out-of-province permit.
Before being engaged by a motor carrier to drive a public service vehicle or a regulated vehicle that is not a public service vehicle, a driver must disclose, in writing, to the motor carrier:
- The name of the province/territory/state in which the driver holds an out-of-province driving permit;
- The class of license held in the province/territory/state;
- Whether the out-of-province permit has been suspended or canceled; and
- The name in which each out-of-province permit was issued.
Before engaging a driver to drive a public service vehicle or a regulated vehicle that is not a public service vehicle, motor carriers must:
- Obtain the driver’s abstract; and
- Review the abstract to determine whether the person is fit to drive.
Annually, the motor carrier must obtain the driver’s driving record current to date no earlier than 30 days before it is obtained and review it to determine if the driver is fit to drive.
It is recommended that the carrier keep a copy of the driver’s application for employment, any records the carrier collected to verify the accuracy of the application, disciplinary actions against drivers, and a copy of the driver’s road test, if applicable.
The driver’s abstract referred to above can be either the regular driver abstract or the commercial driver abstract. Manitoba’s Highway Traffic Act allows the regular driver abstract; however, carriers are encouraged to obtain the more detailed commercial driver abstract.
To obtain the commercial driver abstract, a driver may mail his/her request to Manitoba Public Insurance Driver Records and Suspensions, Box 6300 Winnipeg, MB R3C 4A4, visit a service centre in person, or fax a request to (204) 954-5357.
Carriers are required to periodically review the driver’s files to ensure ongoing compliance.
