Carriers are responsible for keeping records on drivers operating under the carrier’s safety fitness certificate. Drivers operating under the safety fitness certificate can include regular employees and leased operators. The following records are required:
- A transcript of the driving record of each driver employed or otherwise engaged by the carrier, issued by the responsible agency in the jurisdiction in which the driver received the driver’s licence;
- Records of the notification of the carrier of accidents, violations, and convictions relative to each driver while employed by the carrier;
- The driver’s current transportation of dangerous goods (TDG) certificate; and
- Driving incident records.
It is recommended that the driver file also include a copy of the driver’s current licence, an application for employment, a copy of the driver’s signature on applicable company policies, and any other records of driver training the driver has completed. A carrier can also consider adding documentation of any fact-checking it performed to ensure the driver is qualified to operate a commercial motor vehicle.
Carriers are required to keep driver abstracts and accident/violation/conviction reports for at least four years and copies of the TDG certificates for at least two years after they expire.
