Federal regulations
New York has adopted Part 395 of the Federal Regulations.
Applicability
Part 395 applies to intrastate and interstate operations when the vehicle has a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 pounds or more, or is of any size transporting a placardable amount of hazardous materials.
Exception — Part 395 does not apply to the operation of:
- A commercial motor vehicle owned and operated by a farmer or an employee when used in the hauling of farm, dairy, or horticulture products and farm supplies for himself or his farm neighbors to market;
- Tow trucks while responding to requests to provide road service or to remove wrecked, disabled, abandoned, or illegally parked motor vehicles; or
- Utility service vehicles.
Electronic logging device (ELD)
New York has adopted the electronic logging device (ELD) requirements in Part 395 for intrastate motor carriers and drivers.
